Terms & Conditions
"All officially stamped and signed at the official quotes by the client are deemed valid and indicate the client's agreement to proceed with the training or event. By accepting these terms and conditions, the client acknowledges that any stamped and signed quote signifies their consent to participate in the specified training or event."
1. Payment
Payment shall be made payable to Pathway Learning Academy Sdn Bhd
Bank details: As per the invoice
Admittance will only be permitted upon receipt of full payment.
All Team Building/In-House Training – Full payment is required upon confirmation.
All Public Training – Full payment is required upon confirmation.
Other Event – 60% upon confirmation & full payment is to be settled within fourteen (14) days prior to the commencement of training/event.
Payment mode: COD upon confirmation or HRD Corp Claimable, subject to the terms & conditions.
2. Cancellation and Postponement
All cancellations and requests for postponement MUST be submitted in writing to Pathway Learning Academy Sdn Bhd. (An Official postponement notice).
If cancellation and postponement received: -
a. More than 30 working days before the training, total expenses incurred plus 20% surcharge/RM500 service, coordination & administrative charge shall be imposed.
b. Less than 30 working days before the training, 50% of the total fees are chargeable.
c. Less than 21 working days before the training, 100% of total fees are chargeable.
d. Postponement is permitted within a one-year timeframe. Full payment must be collected, and rescheduling is possible within that period, though additional fees may apply upon confirming the new date.
3. Promotion Price & Others terms
Validity of promotion prices are only applied to specific scheduled dates determined by Pathway Learning Academy Sdn Bhd.
Promotional program is not eligible to change on training dates.
Pathway Learning Academy Sdn Bhd reserves the right to reschedule any of the training.
Pathway Learning Academy Sdn Bhd only provides guidance and full set documents for HRDC application and claim, subject to HRDC approval.
In the event of HRDC rejecting or delaying application and claim approval, the total agreed amount as per Official Invoice/Quotation/Confirmation/Proposal is to be-made directly to Pathway Learning Academy Sdn Bhd by client.
Trainer’s and Facilitator’s accommodation with full meals, transportation, mileage, allowances and air flight ticket are fully borne by the client.
Pathway Learning Academy Sdn Bhd reserves the right to change the Program agenda/Itinerary without prior notice.
All FOC items are subject to availability.
4. Obligations to the Client
We act as a booking agent. We are not the direct supplier of the event, transport and activities which make up your training/event
arrangements, unless agreed otherwise. We are obliged and commit ourselves to carry out the Assignment
and will try to select the best suppliers as per agreed by the client.
5. Obligations of the Client
The Client will inform the Participants before participation in the Event that they have to behave in a responsible
manner during all activities so as to uphold our good name and reputation. We hold the right to cancel the
Event or elements thereof in the event that the Participants do not adhere to any warnings issued by us or our supplier.
In such case, the Client will be held fully responsible for payment of the activity as well as for potential damages and
consequently, no refund will be payable to the Client. The Client will confirm to the Participants in writing before the
Event takes place that the Participants will participate in the Event at their own risk and responsibility and notify
in writing to the Participants before the Event takes place all our other terms and conditions which may reasonably
be deemed to be relevant for the Participants, such as, but not limited to:
a. Restrictions on the use of alcohol and drugs and smoking cigarettes;
b. The observance of instructions during the Event;
c. The physical suitability for participation in the Event;
d. The responsibility to participate in an Event on the level of someone’s personal skills and experience;
e. The obligation to sign on the spot of the Event, a waiver form with regard to damages and liability, if required;
f. The possible last-minute cancellation of an outdoor Event in case of extreme weather conditions, if the organizer of the Event so decides.
6. Resources
All electricity, water, and spaciousness of the event are provided by the client.
(For events such as Concert, Exhibitions, Road Show, Wedding Event and Others)
7. Responsibility/Liability
In spite of our careful selection of suppliers, we cannot be held responsible for the execution of the Event by the supplier(s).
More specifically, we cannot be held liable for any other damage than direct damage suffered by the Client.
We cannot be held liable for any damages of whatsoever nature, property loss, injuries or death caused or suffered
by a Participant who was under influence of alcohol or any other drugs.
We cannot be held liable for any damages of whatsoever nature, property loss, injuries or death caused or suffered
by a Participant who did not follow up instructions and safety guidelines instructed by us or our supplier.
The Client will indemnify us for claims from third parties with respect to damages to companies or individuals brought about by a Participant to the Event.
The Client will reimburse us for all costs incurred in relation to any damages brought about by a Participant.
You must ensure that the Participants have adequate insurance with high medical cover
(Including repatriation by air ambulance), and cover for cancellation and curtailment.
8. Circumstances outside our control
We will not be held liable in the event that an Event or part of an Event cannot take place due to circumstances outside
our control, such as, but not limited to cancellation of the Event by the party contracted by us that should carry out
the Event or part of it or illness of the majority of our personnel or national strikes, including but not limited to public transport strikes.
In the event that an Event or part of an Event cannot be carried out, we will do our utmost to find a suitable alternative
for the Client. If such an alternative incurs extra costs, we will first consult with the Client and only proceed after the Client’s written approval.
In the event that an Event or part of an Event arranged by us cannot take place due to circumstances outside our control,
we hold the right to postpone or cancel our Assignment without any legal or financial liability towards the Client or
any third party unless stated by law. In such cases, the agreed financial and/or legal liability rests with the Client.
